2019年儿童和学生用品安全守护行动工作方案
儿童和学生用品质量安全关系青少年儿童的身心健康,关系家庭幸福、社会和谐。近年来,在各级市场监管部门和社会各界的共同努力下,我国儿童和学生用品质量安全形势总体稳中向好。但受经济社会发展不平衡、一些企业质量安全意识和诚信意识薄弱等因素的影响,部分产品、部分领域质量安全状况仍面临一些问题挑战,引起社会极大关注。为落实全国市场监管工作会议要求,守护好儿童和学生用品质量安全,制订本工作方案。
一、总体要求
(一)指导思想。以习近平新时代中国特色社会主义思想为指导,全面贯彻党的十九大和十九届二中、三中全会精神,认真落实党中央、国务院决策部署,以市场监管机构改革为契机,整合监管资源,加强多方联动,提高监管效能,夯实儿童和学生用品质量安全保障线,让青少年儿童穿得称心、用得舒心、玩得开心。
(二)基本原则。
坚持问题导向。聚焦与青少年儿童健康成长密切相关,且人民群众反映问题强烈、社会舆论高度关注的儿童玩具、学生文具、校服、校园跑道原材料等产品,持续开展监督检查和专项整治,不断完善防范措施,有效化解系统性、区域性风险。
坚持综合监管。发挥机构改革综合优势,统筹发挥各项职能作用,综合运用多种监管手段,形成市场监管执法合力。
坚持从严监管。严厉查处质量安全违法违规行为,对伤害青少年儿童人体健康的案件从严从重处罚,提高市场监管执法震慑力。
坚持多方共治。充分发挥行业组织的自律作用、检验检测机构的技术支撑作用、新闻媒体的宣传作用,以及社会舆论和公众的监督作用,推动实现社会共治。
(三)工作目标。通过开展儿童和学生用品安全守护行动,摸清重点儿童和学生用品的生产企业底数和行业质量安全状况。整治一批问题突出的产业集聚区,清理一批违规生产销售的产品,查办一批质量安全违法大案要案,使儿童和学生用品质量安全监管始终保持高压态势。举办多场宣传教育活动,增强学生和家长的质量安全意识,提升安全防范能力。
二、工作重点
聚焦校园跑道原材料。重点抽查用于建设校园跑道的塑胶颗粒、胶水等原材料,检测其安全性能指标。积极为相关部门落实《GB 36246-2018 中小学合成材料面层运动场地》要求提供检验检测技术支撑。
《行动工作方案》还对儿童玩具、学生文具、校服产品作出了要求。
三、工作措施
摸清基本情况。各省、自治区、直辖市及新疆生产建设兵团市场监管局(厅、委)(以下称省级市场监管部门)要组织基层市场监管部门摸清辖区内儿童玩具、学生文具、校服、校园跑道原材料等产品的生产企业数量及信息,并按照统一要求建立企业库,汇总上报;要依托技术机构、行业协会等,结合历年消费者投诉、媒体报道、舆情监测、监管执法数据等,对4类重点产品逐类分析辖区内的质量安全状况,查摆问题,分析原因,提出措施。产业集聚区的市级市场监管部门也要针对本地主打产品,开展质量安全状况分析。
开展生产领域专项治理。市、县(区)级市场监管部门和基层市场监管所要将辖区内的儿童玩具、学生文具、校服、校园跑道原材料4类产品作为重点检查事项,对所有生产企业按照“双随机、一公开”监管要求加强日常监管和隐患排查。重点查看原材料进货记录和检验报告等,检查原材料是否合规。
产业集聚区市、县级市场监管部门要针对突出问题开展专项整治。加大产品质量监督抽查力度,从严从重查处不符合强制性标准要求的产品,严厉打击违法违规行为。推动行业协会广泛开展质量改进、质量攻关等活动,推动技术机构开展质量安全公益培训和强制性标准宣贯。指导行业协会发起质量安全自律倡议,倡导儿童和学生用品行业自律规范发展,自觉履行质量安全承诺,联合抵制质量安全不诚信企业。
工作措施还包括开展校园周边商超等经营领域专项治理,开展电子商务领域专项治理与开展专项宣传教育活动。
四、工作要求
加强组织领导。各省级市场监管部门要加强儿童和学生用品安全守护行动的组织领导,明确职责分工,并结合本工作方案和当地实际,对当地重点产品、重点市场和重点区域进行排查梳理,研究制定针对性更强的行动方案、工作措施。
加大问题处置力度。各地市场监管部门对发现的质量安全事件要严肃处理,立案查处一批不合格产品,整顿治理一批问题企业,清除取缔一批违法企业,曝光移送一批重大案件,依法没收和全部销毁被发现存在严重质量安全隐患的假冒伪劣产品,切实增强监管执法威慑力。加强企业信用监管,将相关信用信息及时归集至国家企业信用信息公示系统,依法向社会公示,将违法企业纳入“黑名单”,加大失信联合惩戒力度,督促企业落实质量安全主体责任。
强化应急处置。聚焦网络舆情、媒体报道,以及消费者集中投诉举报反映较多的儿童和学生用品质量安全信息,加快信息收集研判,及时妥善处理可能出现的各类质量安全问题,努力做到早发现、早处理。要参照《市场监管突发事件应急管理办法》,结合实际,制定应急处置预案,开展应急演练。对重大突发事件,要严格执行应急处置预案,在地方政府统一领导和有关部门各司其职、各负其责的基础上,快速反应、有效处置,防止发生区域性、系统性质量安全风险。
做好新闻宣传。充分利用电视、广播、报刊、网络等渠道,大力宣传儿童和学生用品安全守护行动工作进展和成效,曝光典型案件,震慑违法分子。特别是在“六一”儿童节、开学前集中曝光一批典型案件。做好投诉举报宣传工作,鼓励各地市场监管部门建立有奖举报机制。各省级市场监管部门每季度要向社会公布工作进展情况。
“塑胶跑道新国标”
《中小学合成材料面层运动场地》GB36246-2018
针对近几年发生的校园“毒跑道”现象,2018年5月,国家市场监督管理总局和国家标准化管理委员会正式发布了新国标《中小学合成材料面层运动场地》GB36246-2018。2018年11月1日,新国标正式实施,代替国标《中小学体育器材和场地 第11部分:合成材料面层运动场地》GB/T 19851.11-2005。
这份强制性国标被业内称为“塑胶跑道新国标”,由教育部牵头组织,历经2年多的修订,超过100次的专家会议论证,以及全国范围内的实地考察,收集市场上数百家企业产品并经过不计其数的验证实验后最终出台。新国标的出台以其强制性、科学性和专业性必将促进体育地材行业朝着更加规范和自律的方向发展,为所有运动场地使用者的健康提供了保证。

The quality and safety of children's and student products are closely linked to the physical and mental health of young people, impacting family happiness and social harmony. In recent years, under the joint efforts of various levels of market supervision departments and all sectors of society, the overall situation regarding the quality and safety of children's and student products in China has shown a steady improvement. However, due to factors such as uneven economic and social development and weak awareness among some enterprises regarding quality and safety, as well as integrity, certain products and areas still face challenges in terms of quality and safety, drawing significant public attention. To implement the requirements of the National Market Supervision Work Conference, and to safeguard the quality and safety of children's and student products, this work plan has been formulated.
I. General Requirements
(1) Guiding Principles
Guided by Xi Jinping's Thought on Socialism with Chinese Characteristics for a New Era, we will fully implement the spirit of the 19th National Congress of the Communist Party of China and its second and third plenary sessions. We will earnestly implement the decisions and plans of the central government and the State Council, leveraging the opportunity provided by the reform of market supervision institutions to integrate regulatory resources, strengthen multi-party cooperation, enhance regulatory efficiency, and solidify the safety assurance line for children's and student products. This will ensure that young people are comfortable in their attire, use their products with ease, and enjoy themselves.
(2) Basic Principles
We will adhere to a problem-oriented approach. Focusing on products closely related to the healthy growth of young people, such as toys, stationery, school uniforms, and raw materials for school running tracks, we will continue to conduct supervisory inspections and special rectification campaigns. We will continuously improve preventive measures to effectively mitigate systemic and regional risks.
We will adopt a comprehensive regulatory approach. Leveraging the integrated advantages of the institutional reform, we will coordinate the use of various functions to apply multiple regulatory measures, forming a synergy in market supervision law enforcement.
We will enforce strict regulation. We will severely punish quality and safety violations that harm the health of young people, enhancing the deterrent effect of market supervision law enforcement.
We will promote multi-party governance. We will leverage the self-regulatory role of industry associations, the technical support role of testing institutions, the publicity role of the media, and the supervisory role of public opinion and the general public to promote social governance.
(3) Work Objectives
Through the Children and Student Products Safety Guardian Action, we have identified the production enterprises of key children and student products and assessed the quality and safety conditions in the industry. We have rectified problematic industrial clusters, cleared out non-compliant products, and prosecuted major cases of quality and safety violations to maintain a high-pressure regulatory environment for children and student product quality and safety. Multiple educational and promotional activities have been organized to enhance students' and parents' awareness of quality and safety issues and improve their safety prevention capabilities.
II. Key Work
The action also focuses on school running track raw materials. Key inspections are conducted on the plastic granules and adhesives used in constructing school running tracks to test their safety performance indicators. We actively provide technical support for the implementation of the GB 36246-2018 Standard for Synthetic Material Surface Layers of Sports Grounds in Primary and Secondary Schools.
The action also includes requirements for children's toys, student stationery, school uniforms, and school running track raw materials.
III. Measures
Gather Basic Information. The provincial, autonomous region, municipal market supervision bureaus, and Xinjiang Production and Construction Corps Market Supervision Bureau (hereinafter referred to as provincial-level market supervision departments) should organize grassroots market supervision departments to identify the number and information of production enterprises of children's toys, student stationery, school uniforms, and school running track raw materials within their jurisdictions. They should establish a database according to unified requirements and report it; they should also rely on technical institutions and industry associations, combining historical consumer complaints, media reports, public opinion monitoring, and regulatory enforcement data, to analyze the quality and safety conditions of these four categories of products in their regions, identify issues, analyze causes, and propose solutions. Municipal-level market supervision departments in industrial clusters should also conduct quality and safety analyses on their local main products.
Conduct Specialized Governance in Production Fields. At the municipal and county (district) levels, as well as at grassroots market supervision stations, children's toys, student stationery, school uniforms, and school running track raw materials should be prioritized for inspection. All production enterprises should be subject to routine supervision and hazard identification according to the 'double random, one open' regulatory requirements. Focus on reviewing purchase records and test reports of raw materials to ensure their compliance.
Municipal and county-level market supervision departments in industrial clusters should conduct specialized governance targeting prominent issues. They should intensify quality supervision spot checks, severely punish products that do not meet mandatory standards, and crack down on illegal and non-compliant behaviors. They should promote industry associations to widely carry out quality improvement and quality breakthrough activities, and encourage technical institutions to provide public training on quality and safety and promote the implementation of mandatory standards. They should guide industry associations to initiate self-regulatory initiatives for quality and safety, advocating for self-discipline and compliance in the children's and student products industry, and jointly opposing non-compliant enterprises.
Measures also include specialized governance in school surroundings, online business supervision, and special educational campaigns.
IV. Requirements
Strengthen Leadership and Organization. Each provincial market supervision department should strengthen the leadership and organization of the Children and Students' Products Safety Protection Campaign. They should clarify their responsibilities, and in conjunction with this work plan and local realities, conduct inspections and sort out key products, key markets, and key areas. They should develop more targeted campaign plans and work measures based on these inspections.
Enhance the Handling of Issues. Local market supervision departments must seriously handle discovered quality and safety incidents, file cases and investigate a batch of substandard products, rectify and govern a batch of problematic enterprises, eliminate and ban a batch of illegal enterprises, and transfer a batch of major cases. Confiscate and destroy counterfeit and shoddy products with serious quality and safety hazards in accordance with the law to enhance the deterrence of regulatory law enforcement. Strengthen enterprise credit supervision, collect relevant credit information in a timely manner to the National Enterprise Credit Information Publicity System, and publicize it to the society in accordance with the law. Include illegal enterprises in the 'blacklist', increase the intensity of joint punishment for dishonesty, and urge enterprises to implement their main responsibilities for quality and safety.
Enhance Emergency Response. Focus on network public opinion, media reports, and consumer complaints about children and students' product quality and safety issues. Quickly collect and analyze information to promptly handle potential quality and safety problems. Develop emergency response plans based on the

New National Standard for 'PVC Tracks': GB36246-2018 for Middle and Primary School Synthetic Material Surface Sports Fields
In response to the recent incidents of toxic running tracks in schools, the State Administration for Market Regulation and the Standardization Administration of China officially released the new national standard GB36246-2018 for Middle and Primary School Synthetic Material Surface Sports Fields on May 2018. The new standard took effect on November 1, 2018, replacing the national standard GB/T 19851.11-2005 for Middle and Primary School Sports Equipment and Grounds - Part 11: Synthetic Material Surface Sports Fields.
This mandatory national standard, known as the 'New National Standard for PVC Tracks', was developed under the leadership of the Ministry of Education after over two years of revision, more than 100 expert meetings, and extensive on-site investigations. It collected data from hundreds of companies and underwent countless validation tests.
